Terms of Service

Article 1 – Definitions
In these terms and conditions, the following definitions apply: Cooling-off period: the period during which the consumer can exercise their right of withdrawal; Customer: the natural person who is not acting in the course of a profession or business and who enters into a distance agreement with the entrepreneur; Day: calendar day; Ongoing transaction: a distance agreement relating to a series of products and/or services, for which the delivery and/or purchase obligation is spread over time ;Durable data carrier: any tool that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future access and unaltered reproduction of the stored information; Right of withdrawal: the consumer’s right to cancel the distance agreement within the cooling-off period; Entrepreneur: the natural or legal person who offers products and/or services remotely to consumers; Distance agreement: an agreement concluded in the context of a system organized by the entrepreneur for remote sales of products and/or services, where exclusive use is made of one or more means of distance communication up to and including the conclusion of the agreement; General Terms and Conditions: these present General Terms and Conditions of the entrepreneur.

Article 2 – Identity of the Entrepreneur
This website (www.parfumello.com) (hereinafter the “Website”) is managed by Parfumello, operating under the trade name “www.parfumello.com,” registered with the Chamber of Commerce in Amsterdam under number 87292610.

Article 3 – Applicability
These general terms and conditions of sale (the “Sales Terms”) are agreed between
www.parfumello.com (the “Seller”) and any natural person acting for purposes outside their commercial, industrial, artistic or professional activity who wishes to make a purchase through the Website (the “Customer”) (hereinafter collectively referred to as the “Parties”). Placing an order via the Website implies prior consultation and full acceptance by the Customer of these Sales Terms. These Sales Terms will be available on the Website and serve as the foundation on which the Parties have agreed to conduct their relationship. www.parfumello.com reserves the right to modify these Sales Terms at any time and without notice by publishing a new version on the Website. The applicable version of the Sales Terms is the one available on the Website at the time the order is placed by the Customer. These Sales Terms are binding and cannot be altered under any circumstance by the Customer.

Article 4 – The Customer
Customers placing an order via the Website must be at least 16 years old. If the Customer is under the age of 16, they must have parental consent to place an order via the Website. The Customer therefore declares to have the necessary legal capacity to enter into an agreement. www.parfumello.com reserves the right to request proof of age or parental consent and may cancel the order (with refund) if the Customer fails to provide the requested proof. When the Customer provides information via the Website required for the delivery and invoicing of products, they must ensure that this information is current and complete. In case of an error in the recipient's contact details, www.parfumello.com cannot be held liable if it proves that delivery of the ordered products was impossible. www.parfumello.com reserves the right to cancel an order (with refund) if it suspects non-compliance with the aforementioned conditions, without being held liable.

Article 5 – The Offer
The products of www.parfumello.com or any other product offered for sale by
www.parfumello.com (hereinafter the “products”) are those displayed on the Website on the date of the Customer’s visit. www.parfumello.com ensures to present and describe the products on the Website as accurately as possible. However, images and descriptions of the products are for indicative purposes only and are not contractually binding. www.parfumello.com is not liable for any errors or discrepancies in the presentation of the products. www.parfumello.com will fulfill Customer orders as long as stock lasts and will do its best to ensure that products offered on the Website are available.

Article 6 – Orders
The Customer explicitly acknowledges that placing an order constitutes a distance
agreement with a payment obligation. Once payment is completed (see Article 6), the
Customer will receive an email from www.parfumello.com confirming receipt of the order with an order summary. This message will be sent to the email address provided by the Customer.

Article 7 – Unavailability
If one or more of the product(s) ordered by the Customer are temporarily or permanently unavailable, or if the initially indicated delivery period is exceeded by more than eight (8) days, www.parfumello.com will inform the Customer by email. In such case, the Customer has the option to modify or cancel their order by sending an email to support@parfumello.com within fifteen (15) working days after being informed.
www.parfumello.com will refund the amount paid by the Customer as soon as possible.

Article 8 – Prices
Product prices are displayed on the Website in euros (€) for deliveries within Europe. All
amounts include VAT, excluding delivery costs and/or taxes that cannot reasonably be
calculated in advance. Delivery costs depend on the shipping destination and are explicitly stated in the order summary prior to payment. In case of withdrawal, return shipping costs are borne by the Customer. Promotional discounts will be applied to the order if the Customer meets the criteria and enters the promotional code(s) correctly. www.parfumello.com reserves the right to change prices on the Website at any time without prior notice. The applicable prices are those displayed at the time of placing the order.

Article 9 – Payment
The Website allows secure payments via iDEAL, Apple Pay, Klarna, credit card, and banktransfer. No bank details are stored on the server, and www.parfumello.com has no access to the Customer’s banking information. Payments are processed via the payment platform Mollie, which guarantees enhanced security for transactions.

If the Customer wishes to pay using a foreign debit or credit card, the card must be
authorized for international transactions. Any costs arising from the chosen payment
method are borne by the Customer. The Customer guarantees that they are authorized to use the bank card for payment. The total amount payable for the order is displayed to the Customer on the “cart” page summarizing the selected products. Before proceeding to payment, the Customer has the opportunity to review and correct any errors in their order. Once the order is placed, it becomes final, without prejudice to the right of withdrawal. By providing their bank details (full name, card number, expiry date, and CVC code), the Customer expressly consents to the total amount being debited. The Customer’s account will only be debited when the product is shipped, ensuring that the Customer is not charged for unavailable products. If payment is made despite unavailability, www.parfumello.com will issue a refund or, with the Customer’s agreement, send a replacement item.

Article 10 – Ownership
Products remain the property of www.parfumello.com until full payment of all invoices has been made, including fees and taxes.

Article 11 – Delivery
The order will be delivered to the delivery address provided by the Customer when placing the order via the Website. If delivery cannot take place or if the Customer refuses the delivery, the order will be returned to www.parfumello.com. www.parfumello.com will refund the amount to the Customer within fifteen (15) days of receiving the returned order. If www.parfumello.com is held liable, the Customer must provide proof of this liability. Furthermore, www.parfumello.com is fully released from liability if it proves that the non-performance of the agreement was due to the Customer’s fault, the result of an unforeseeable and unavoidable act by a third party, or force majeure.

Article 12 – Delivery Period
Upon receipt of payment, www.parfumello.com will take the necessary steps to deliver the ordered products as soon as possible. Delivery times may vary depending on the country of destination selected by the Customer and the time the order is placed. Generally, delivery times – except in exceptional cases – will not exceed eight (8) days from the day following payment. Delivery times depend on: (1) processing time by www.parfumello.com, (2) the carrier’s delivery time, and (3) customs clearance.

Article 13 – Right of Withdrawal
The Customer has a legal cooling-off period of fourteen (14) days from the date the
Customer (or a third party designated by the Customer, who is not the carrier) physically receives the products ordered via the Website, to withdraw from the order without having to provide any reason. Products purchased directly from distributors, retailers, or other websites besides the Website cannot under any circumstances be returned to www.parfumello.com.

To be eligible for a refund, the Customer must notify www.parfumello.com of their decision to withdraw before the end of the withdrawal period and prior to returning the products. This must be done via email to support@parfumello.com, stating the order number. Return shipping costs are borne by the Customer. Products must be returned within fourteen (14) days of notifying www.parfumello.com of the decision to withdraw.
Products must be returned in their original condition and packaging. www.parfumello.com will refund payments received from the Customer if the order is returned in full. However, return shipping costs will be borne by the Customer and may be deducted from the refund. Refunds for returned products will be issued to the same bank account used for payment, within fourteen (14) days after www.parfumello.com has received the return shipment, in accordance with the above terms. If the return package is not received by www.parfumello.com and the Customer cannot provide proof of shipment, the products will not be refunded, and www.parfumello.com cannot be held liable. Packages received but not returned according to the stated procedures will not be refunded. The risk of returning products lies with the Customer.

Article 14 – Delivery Errors
If the Customer receives a product that does not match the order, they must inform
www.parfumello.com as soon as possible via support@parfumello.com and within fourteen (14) days of receiving the order. www.parfumello.com will then verify the issue and inform the Customer of the return procedure, which will be at www.parfumello.com’s expense. If products were personalized at the Customer’s request, the right of withdrawal does not apply.

Article 15 – Warranty
All products sold via the Website www.parfumello.com are covered by statutory warranties. To invoke these warranties, the Customer must have the invoice issued by www.parfumello.com. In the event of a defect, the Customer must notify www.parfumello.com as soon as possible, and in any case within fourteen (14) days of discovering the defect. The statutory warranty does not apply to defects caused by accidents, negligence, improper use, failure to follow instructions, modifications to the product, or any other incorrect use by the Customer.

Article 16 – Privacy and Cookies
The Customer must provide personal data to www.parfumello.com, which is collected during the ordering process. This data is stored on durable data carriers. If this information is not provided, www.parfumello.com will not be able to process the Customer's order.

Article 17 – Evidence
The Customer acknowledges that electronic communications and backups made by
www.parfumello.com may serve as proof of a transaction between the Customer and
www.parfumello.com.

Article 18 – Force Majeure
www.parfumello.com is not liable for complete or partial failure to comply with the Sales
Terms in the event of force majeure, including, but not limited to, issues with custom authorities, strikes, bankruptcy of third parties relied upon by www.parfumello.com, failure or delay in delivery by third-party suppliers of www.parfumello.com, or trade restrictions and new regulations.

Article 19 – Applicable Law and Jurisdiction
These Sales Terms are subject to Dutch law, regardless of the country of delivery, without prejudice to consumer protection rules in the Customer’s country of residence.
Before initiating legal proceedings, the Parties must attempt to resolve their dispute
amicably. If this is not possible, any dispute relating to the interpretation and/or execution of the Sales Terms shall be submitted to a court in the Netherlands.
